Spoke Software Announces Safe Harbor Certification

Spoke Software Continues Privacy Leadership by Adopting U.S. - EU Safe Harbor Principles and Earning TRUSTe Seal

Palo Alto, CA, - September 29, 2004 - Spoke Software, a provider of relationship capital management solutions, announced today that it has certified its compliance with the U.S.-European Union Safe Harbor data privacy principles to the U.S. Department of Commerce. TRUSTe, an independent non-profit organization dedicated to monitoring Internet privacy standards, has reviewed Spoke Software's practices and awarded it the TRUSTe EU Safe Harbor Privacy Seal. Spoke's certification ensures its ability to engage in uninterrupted data transactions with individuals and businesses in the European Community and further indicates Spoke's dedication to setting the pace for relationship capital management companies on privacy, security and protection of confidential data.

Spoke has voluntarily submitted its privacy practices to review by TRUSTe since its public launch in 2003 and was the first relationship capital management company to appoint a Chief Privacy Officer. Its achievement of compliance with the Safe Harbor principles required no material changes in Spoke's industry-leading practices.

The European Commission's Directive on Data Protection limits the transfer of personal data to non-European Union nations that do not meet the European "adequacy" standard for privacy protection. While the United States and the European Union share the goal of enhancing privacy protection for their citizens, their approaches to achieving that goal differ. The Safe Harbor framework was developed by U.S. Department of Commerce and the European Commission to bridge the gap in privacy approaches between the United States and the European Union and to provide a streamlined means for U.S. organizations to comply with the European Commission's Directive.

As part of its review process, Spoke Software engaged TRUSTe, a third-party reviewer, to validate and confirm the consistency of its privacy promises with the Safe Harbor principles, which involved rigorous evaluation activities designed to assure its compliance. These principles include providing notice and choice about how personal data is used, providing individuals access to their personal information and enforcing effective procedures for ensuring continued compliance.
